1. Acceptance of Terms

By accessing or using Crave Menu, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Description of Service

Crave Menu provides a digital menu creation platform that allows restaurants to create, manage, and share interactive menus with video content. The platform also allows menu viewers to save items to wishlists.

3. User Accounts

3.1 Restaurant Owners

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate information when creating your account.

3.2 Menu Viewers

When you create a Crave Menu account to save wishlists, you agree to provide accurate information and to comply with these terms.

4. Content

4.1 Your Content

You retain ownership of content you upload (menu items, images, videos, etc.). By uploading content, you grant Crave Menu a non-exclusive license to display, distribute, and promote your menu content as part of the service.

4.2 Prohibited Content

You agree not to upload content that:

  • Infringes on intellectual property rights
  • Is false, misleading, or deceptive
  • Is illegal, harmful, or offensive
  • Contains malware or harmful code

5. Customer Data and Marketing

5.1 For Restaurant Owners

When customers opt in to share their information with your restaurant, you agree to:

  • Use the data only for the stated marketing purposes
  • Comply with all applicable privacy laws (GDPR, CCPA, CAN-SPAM, etc.)
  • Honor unsubscribe requests promptly
  • Protect customer data with appropriate security measures
  • Not sell or share customer data with third parties

5.2 For Menu Viewers

When you opt in to marketing from a restaurant, you understand that:

  • The restaurant will have access to your contact information
  • You may receive marketing communications from that restaurant
  • You can withdraw consent at any time

6. Intellectual Property

The Crave Menu platform, including its design, features, and technology, is owned by Crave Menu and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the service.

7. Copyright Policy (DMCA)

Crave Menu respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). If you believe that content on the platform infringes your copyright, you may submit a written notice to our designated Copyright/DMCA Agent.

Your notice must include:

  • A physical or electronic signature of the copyright owner or authorized agent
  • Identification of the copyrighted work claimed to be infringed
  • Identification of the allegedly infringing material and its location on the platform
  • Your name, address, telephone number, and email address
  • A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf

We will respond to valid notices in accordance with the DMCA, which may include removing or disabling access to the allegedly infringing material. Repeat infringers may have their accounts terminated.

8. Disclaimer of Warranties

The service is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, Crave Menu shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service.

10. Indemnification

You agree to indemnify, defend, and hold harmless Crave Menu and its parent, subsidiaries, affiliates, officers, directors, employees, agents, licensors, and service providers (collectively, the "Indemnified Parties") from and against any and all claims, demands, actions, suits, proceedings, investigations, liabilities, damages, losses, judgments, fines, penalties, costs, and expenses (including reasonable attorneys' fees, court costs, and expert fees) that arise out of or relate to:

  • Your access to or use of the service;
  • Any content you upload, submit, post, transmit, or otherwise make available through the service;
  • Your violation or breach of these Terms of Service or any applicable law or regulation;
  • Your violation of the rights of any third party, including intellectual property, privacy, publicity, or data-protection rights; and
  • Any dispute or interaction between you and any other user, customer, or third party.

Without limiting the foregoing, if Crave Menu or any Indemnified Party is sued, threatened with legal action, or otherwise held responsible as a result of your acts, omissions, content, or conduct, you agree that you are solely and fully liable for that claim, and you shall pay, reimburse, and be financially responsible for all resulting losses, damages, settlements, judgments, and legal costs (including reasonable attorneys' fees) incurred by the Indemnified Parties.

Crave Menu reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with Crave Menu's defense of that claim. You will not settle any claim that imposes any obligation or liability on, or requires any admission from, an Indemnified Party without that party's prior written consent. This indemnification obligation survives the termination of these terms and your use of the service.

11. Termination

We may terminate or suspend your account at any time for violation of these terms. You may also delete your account at any time. Upon termination, your right to use the service will immediately cease.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the service.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Crave Menu operates.
